Terms and Costing Conditions for Activities, Hotels and Transport
We aim to deal fairly, professionally & efficiantly
General
1.1 In these terms and conditions ‘we’, ‘our’ and ‘us’ means Party Central Limited, ‘you’ means the group leader and the ‘group’ means all the people who are included in the travel, accommodation and activity arrangements booked.
1.2 Your contract is with Party Central Ltd and comes into being when you place a booking request and pay a deposit and when we have accepted your deposit and issued you with a booking confirmation. Our acceptance of your booking requires you and all members of your group to agree to and adhere to these terms and conditions.
1.3 We may amend these terms and conditions without notice, but we will forward any changes to this contract that will be accepted as part of these revised & updated terms and conditions. Please note completed reservations are governed by the terms and conditions in place at the time of booking.
Responsibilities of Group Leader
2.1 We will forward all communications and hold all conversations with you, the group leader and will take your response as being representative of the group. Contact with other group members could cause confusion. It is the responsibility of the group leader to communicate all details to the rest of the group. If at any point there is a change of group leader; we will only accept this change when written confirmation of the change has been received by us.
2.2 The group leader accepts responsibility for the invoice and is therefore liable for its payment to us by the due date. The group leader in accepting liability for the payment of the invoice on behalf of the whole group and is responsible for the collection of all monies due from the individual group members.
2.3 It is the responsibility of the group leader to ensure that everyone in the group is aware of and agree to our terms and conditions. Please note that your acceptance and therefore the acceptance of your whole group to our terms and conditions are made at time of booking.
Booking
3.1 The group leader and all other members of your group must be aged 18 years or over.
3.2 Please note that all guide prices on our web site and in any of our literature are based on the information received from our suppliers at the time of their preparation. The photographs and descriptions are used as examples of facilities available and equipment used for that type of activity.
3.3 You may make an enquiry and choose to make a provisional booking with us by telephone or through our website. We will then check the availability and prices of your chosen options prior to giving you our quotation. We will endeavour to advise you of this by telephone where possible but will also send a written quotation to you by letter, e-mail or fax within 48 hours or in any event within 72 hours. This will be based on current prices. Our quotation to you will remain open for a maximum period of 7 days from its date and is offered subject to availability. Our quotations are inclusive of VAT. We do not provide a VAT breakdown or receipt.
3.4 Although provisional bookings may be made by telephone or through our website, confirmation of your booking will only be accepted by us in writing by letter, e-mail or fax or on receipt of the completed and signed booking form sent out to you with our quotation. You must complete, sign and return this booking form to us even if your booking is already confirmed. In making a booking with us by any method, your acceptance and therefore that of your group of our terms and conditions is understood.
3.5 You must pay a deposit in order to confirm and secure your booking with us.
1. Itineraries that include accommodation need a £200 deposit.
2. Activities or events arranged without accommodation need a 50% deposit.
3. Tickets for certain events may need to be paid for in full at time of booking.
3.6 Payment of your deposit may be made with a valid credit card. Credit card payments will incur a charge of 2.5% to cover our costs for the transaction. Alternatively, you may choose to send us a cheque made payable to Party Central Limited. However, please note that if payment by cheque is chosen your booking cannot be confirmed until your cheque has cleared in our account.
3.7 We will confirm your booking on receipt of your deposit or payment in full and will give you a Invoice Reference Number. On receipt of your deposit, we will make your chosen reservation at the same price and with your chosen activities and events. However, at this stage, in the unlikely event that we are unable to confirm your reservation with our suppliers and we are unable to offer you an acceptable alternative for any part of your chosen package, we will return all monies already paid to us by you.
3.8 On receipt of your booking confirmation and deposit, we will send you an invoice. On receipt of your invoice it is important to check all the details. Please contact Party Central immediately if you feel there are any discrepancies. We will investigate and clarify any queries you may have.
Payments
4.1 Final payments must be made at least 49 days prior to your departure date if paid by credit card. Credit card payments carry a charge of 2.5% to cover our transaction costs. We must receive any payments made by cheque at least 56 days prior to your departure date to allow for clearance through our account. Any reservations made by you within 49 or 56 days (dependent upon method of payment as above) prior to your departure date must be paid for in full at the time of booking. If we do not receive full payment by the due date specified by us, we reserve the right to cancel your reservation.
4.2 Once you have confirmed your booking the price will not usually change as long as you have not requested any changes in your agreed arrangements and as long as your group size remains the same.
Special Requirements and Special Requests
5.1 Special Requirements may include but are not limited to disabled access or dietary requirements and other items that are essential to enjoyment of your Party Central itinerary. If you notify us of any special requirements as soon as possible prior to your departure, we will do our utmost to satisfy these. However, we cannot be held liable if the Special Requirement does not occur or is not possible.
5.2 Special Requests are any additional preferences or enhancements that you may want us to arrange for you. If you tell us about these as soon as possible in advance of your date of departure, we will do our best to meet these but can offer no guarantees. It may not always be possible to notify you prior to your departure that your special requests cannot be met. If we cannot meet your special request we will not pay any compensation.
Changes Made By You
6.1 You can make changes to the number and the identity of the members of your group, activities, services and accommodation up to 52 days before your date of departure. Please note that in some instances, there is a minimum or maximum number of persons required to enable the activity or service to be provided. If this if the case, please be aware that Party Central cannot be held responsible for the cancellation of any such activities or services which have to be made as a consequence of a change in your group size by you. In other cases, it may be possible to proceed despite a change in your group size. However, please note that any change could incur additional charges. Party Central will always do its best to find solutions and acceptable alternatives if your original choices are not possible due to a change in your group size although we cannot always guarantee to do this as changes are subject to availability at the time.
6.2 We will endeavour to advise you by telephone of the details of any changes requested by you with any price adjustments and will confirm these changes to you in writing by letter, fax or e-mail within 24 hours or in any event within 72 hours. You will be deemed to have accepted all changes made if you do not notify us within 7 days of the notice of the changes that you wish to cancel all or part of the event.
6.3 If you wish to make any changes within 52 days of the date of departure these must be agreed by us and may carry an administration fee. For bookings that are made within the 52 days prior to your departure date your final group details and requirements are required within 72 hours and can only be changed in exceptional circumstances.
6.4 All cancellations need to be made in writing by the group leader. The date of cancellation will be the date of receipt of this written cancellation by us. Depending on the date of cancellation, you must pay the following cancellation charges.
1. More than 52 days from date of departure 100% of the total value of your reservation made with Party Central, subject to a maximum value of any deposit paid; unless less than seven days have passed from date of booking, in which case there is no cancellation charge.
2. Between 14 and 52 days from date of departure 50% of the total value of your reservation made with Party Central
3. Less than 14 days from date of departure 100% of the total value of your reservation made with Party Central.
Changers Made By Us
7.1 Once you have confirmed your booking with Party Central, the price will not usually change providing that you have requested no changes to the arrangements and/or group size agreed at the time of booking. However, in some circumstances price changes may be unavoidable due to a significant change in our costs, in relation to your reservation, arising after the time of booking.
7.2 If your booking with us was made more than 49 days prior to your date of departure and any of our costs in relation to your reservation with us should change significantly after accepting your booking, we will notify you of these in writing a.s.a.p. but in any case no later than 30 days before your departure date. We will also endeavour to contact you via telephone. This written notification will be sent to you within 72 hours of information relating to any significant price changes being notified to us by our suppliers. You are then free to cancel all or part of your booking.
7.3 You will be deemed to have accepted the price changes if you do not notify us in writing that you wish to cancel all or part of your booking with Party Central within 7 days from the date on our written notification of the price changes to you. If a significant price decrease should arise in our costs, in relation to your reservation, any monies already paid by you, which become due to you as a result of such a circumstance, will be refunded to you by Party Central.
7.4 If you have made a booking within 49 days of your date of departure, we will do our best to ensure there are no price changes. However, this cannot be guaranteed and we reserve the right to demand payment for any additional charges accrued by us owing to the nature of the late booking.
7.5 We try to avoid making any changes to your chosen arrangements once your booking has been confirmed. We offer goods and services on behalf of our suppliers in good faith. However, in some instances, given itineraries may be planned many months in advance, this may not always be possible. For example, we cannot allow for a particular activity supplier or service provider no longer being able to offer a particular activity or service or changing their schedules. Therefore, if any changes have to be made due to operational or reasons beyond our control we reserve the right to amend or make substitute alternative arrangements to any element of your booking to an equal or greater standard or value. If this is not possible and any changes to your reservatiopn result in a reduction to the value of your reservation we will refund any difference to you.
7.6 On rare occasions, it may be necessary to make major changes to your reservation. If this should be the case, we will always try to find solutions and alternatives to offer you. Major changes could include but are not limited to; a change in accommodation rating; a change in chosen activity, a change in location. If we should need to make a major change to your reservation, you may accept the change or cancel your reservation and receive a full refund. In a case where the value is lower than your original booking, we will refund any difference that becomes due to you if you should decide to proceed with your reservation.
7.7 Party Central cannot be held responsible for any delay, the cancellation or any changes made or any third party obligations resulting from a case of ‘Force Majeure’. This includes but is not limited to war, threat of war, civil disobedience or strife, industrial dispute, terrorist activity, natural or industrial disasters, fire, and adverse weather conditions. If an activity that is dependent upon weather conditions has to be cancelled, Party Central will offer a voucher for that activity which can be redeemed within the six months following your original booked date.
7.8 Party Central reserve the right to revise the prices for overseas destinations if considerable fluctuations occur with the currency exchange rate.
Your Responsibilities
8.1 Unacceptable behaviour by you or any other member of your group could result in the whole or part of your itinerary being cancelled by Party Central or any of our suppliers. We will not be liable to complete, adjust or make any refunds in relation to your booking arrangements in such circumstances. Behaviour is unacceptable if in our opinion it could cause distress, damage or danger to or annoy our other customers, employees, property or anyone else. You must also accept any costs incurred as a consequence of such behaviour by any member of your group.
8.2 If for any reason, any of our suppliers see fit not to admit or allow some or your entire group to participate or partake in an activity or service due to the unruly or disruptive behaviour of you or any other members of your group there will be no entitlement to any refund.
8.3 Alcohol is not permitted at most activity centres prior to taking part in activities which often involve high levels of concentration and/or driving skills. Anyone deemed to be under the influence of alcohol or drugs will not be allowed to participate.
8.4 For all accommodation arrangements the group leader or another nominated member of the group, who accepts this responsibility, must complete and sign an Accidental Damage and Deposit Form which we will send out to you with your booking confirmation from us. Please return this to Party Central as soon as possible. This form, which may be forwarded to your accommodation provider by us, includes a section, which gives a signed and valid credit card authority to be held by the hotel management for the duration of your group’s stay. Please ensure that you have this card with you when booking in. This form includes a section, which gives a signed and valid credit card authority for the duration of your stay to cover any accidental damage caused by any member of your group at your booked accommodation. Please ensure that you have this card with you when booking in. Some accommodation providers may also insist on a cash deposit at the time you check in with them in addition to afore mentioned Accidental Damage and Deposit Form. We will do our best to notify you, prior to your date of departure, if this should be the case but this cannot be guaranteed. If you should object to us passing a member of your group’s credit card details to any of our accommodation suppliers you must let us know immediately. Please note that this could result in us not being able to make a booking with certain accommodation suppliers. Please refer to the Party Central Privacy Policy, which states that you can be assured that your information will not be passed to any other trader or third party, except for the purpose of making your activity booking and if applicable your accommodation booking with our suppliers.
8.5 Some clubs and event venues may require one or more members of your party to leave identification and/or a credit card behind reception to allow entry. We will do our best to notify you prior to your date of departure if this should be the case but this cannot be guaranteed. Failure to comply with the wishes of the supplier may result in refusal of entry.
8.6 If you experience a problem whilst you are away with any part of your itinerary, you must report this immediately to the activity or service provider in order that they have the opportunity to rectify the problem. If at this stage, any third party service providers are unable to resolve your problem please inform us and we will do our best utmost, but cannot guarantee to resolve the situation to prevent part or the whole of your reservation from being spoiled. Any complaints must be made in writing by letter, fax or e-mail and must be received by Party Central within 14 days from the date of your return and should clearly state the problem/s you or any member of your group experienced.
8.7 We do our best to make sure that our suppliers adhere to strict health and safety standards and are covered by the appropriate risk assessments and insurances. However, it is your responsibility to ensure that you and your group comply with all the requirements, instructions and terms and conditions relating to your reservation with Party Central received by you from us or any of our suppliers.
8.8 We strongly advise that each member of your group takes out the appropriate insurance cover for the duration of the package booked. Some activities contain an element of risk and all group members participating must assume responsibility.
Our Responsibilities
9.1 It is our responsibility to ensure that the activities and other services that constitute the package you have booked, are booked and available to you. We endeavour to be aware of and update our information accordingly if any of our suppliers change their activity or service provision, schedules or prices. However, if any supplier has made false representations to us in relation to the facilities they offer or are in breach of implied warranties of any kind, we cannot be held liable for any loss arising if we had no idea that such suppliers were not acting in good faith.
9.2 On receipt of your balance, we will prepare your Party Central Travel Pack which will include your group’s personalised itinerary, local information and all tickets and other information you require for the smooth running of your reservation.
9.3 We do our utmost to ensure that your itinerary is well planned and timed to best advantage for your group. However, we advise that your group arrives 15 minutes before the start times on your itinerary to ensure maximum participation time and the smooth running of activities booked. Lateness could result in cancellation and if this were the case Party Central cannot be held liable.
9.4 If any of our suppliers fail to provide the service they agreed at the time of your original booking on receiving your complaint we will investigate the matter thoroughly. We will refund the cost of any part of your reservation affected or issue a credit voucher entitling your party to a reservation to be taken within six months of the original date booked. Please note that the maximum value of any refund or credit voucher cannot exceed the cost of the original booking.
9.5 Provided that nothing in this condition shall operate so as to exclude our non-excludable liability in respect of death or personal injury caused by our negligence, or to affect your statutory rights as a consumer, or to exclude liability for fraudulent misrepresentation, we shall not be liable to you or your group in contract, tort (including without limitation negligence) and/or breach of statutory duty for any loss or damage or for any loss of production or any indirect or consequential (including economic) loss which you or any member of your group may suffer by reason of any act, omission, neglect or default (including negligence) in the performance of these conditions by us, our servants or agents in a sum that is greater than the cost of your Party Central reservation.
